End User Licence Agreement

This is a draft agreement for launch. Have it checked by a lawyer before you rely on it.

This agreement is between you and Rahat Khondokar, an individual operating from Bangladesh (the “Licensor”), for the MotionShine Mac app and its updates (the “App”). MotionShine is developed by Rahat Khondokar. The macOS app is code-signed and notarized by Amariq LLC, the holder of the Apple Developer account, which is why that name may appear in macOS security dialogs. By installing or using the App you accept it. If you do not accept it, do not install or use the App.

1. Licence

The Licensor grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on Macs you own or control.

  • Free. You may use the App without a key, with every feature and no time limit. Exports are limited to 720p at 30 fps.
  • Licence. A licence key unlocks 1080p, 1440p, 4K and 60 fps exports on up to [two] Macs at the same time. A key belongs to the person or single business that bought it.

2. Restrictions

  • Do not copy, sell, rent, lend or share the App or a licence key, other than backups for your own Macs.
  • Do not reverse engineer, decompile or modify the App, or remove licence checks, except where the law allows it.
  • Do not use the App to record people or content without the consent or rights the law requires.

3. Ownership

The App is licensed, not sold. The Licensor and its licensors keep all rights in the App, including its code, design and name. Open-source components stay under their own licences.

4. Your content

Your recordings, projects and exports belong to you and stay on your Mac. The Licensor does not receive them and claims no rights in them.

5. Updates

The App may check for updates. Updates are covered by this agreement. Support for old versions of the App or of macOS may end.

6. Payment and refunds

Licences are sold by Polar as merchant of record. Refunds follow the Refund Policy. A refunded or charged-back key may be switched off.

7. Privacy

How the App and the website treat personal data is described in the Privacy Policy.

8. No warranty

The App is provided “as is”, without warranties of any kind, including fitness for a particular purpose and uninterrupted or error-free operation. Keep backups of recordings that matter to you.

9. Limit of liability

To the extent the law allows, the Licensor is not liable for indirect or consequential damages, or for lost data or profits. Total liability is limited to the amount you paid for the App in the 12 months before the claim, or US$50 if you use the free version.

10. Ending this agreement

It runs until ended. You can end it by deleting the App. It ends automatically if you break it, and the Licensor may then switch off your key.

11. Governing law

This agreement is governed by the laws of Bangladesh. Mandatory consumer rights where you live are not affected.
