Terms of Service

These are draft terms for launch. Have them checked by a lawyer in your country before you rely on them.
These terms cover your use of the MotionShine website and the MotionShine Mac app (together, the “Service”). By using the Service you agree to them.
1. Who is the seller
MotionShine is made and sold by Rahat Khondokar, an individual operating from Bangladesh (“I”, “me”, “we”). Contact: [email protected].
2. The app and licences
MotionShine is free to use, with every feature and no watermark. The free version exports up to 720p at 30 fps. A paid licence unlocks 1080p, 1440p, 4K and 60 fps exports. A licence is a personal, non-exclusive, non-transferable right to use the app, under the EULA. You are buying a licence to use the software, not the software itself.
3. Payment
Payments are processed by Polar (polar.sh), the merchant of record. Polar runs checkout, collects and pays any applicable taxes, issues receipts and generates licence keys. I never see or store your card details.
Prices are shown at checkout before you pay. A licence is a one-time payment, not a subscription. Your licence key is sent to the email you give at checkout, so please type it carefully. Polar’s own terms apply to the payment.
4. Refunds
The Refund Policy is part of these terms.
5. Acceptable use
- Do not share, resell or publish licence keys, or use a key on more Macs than it allows.
- Do not reverse engineer the app or remove licence checks, except where the law allows it.
- Do not use the app to record people without the consent the law requires where you are, or to break the law or anyone’s rights.
- Do not attack or overload the website or its systems.
I may end a licence that is used against these rules. If this happens because of a breach, no refund is due.
6. Your content
What you record and create is yours. The app keeps recordings on your Mac. I claim no rights in them, and you are responsible for having the right to record and share what you record.
7. Updates
I release updates to fix problems and add features. I may stop supporting old versions of the app or of macOS, with reasonable notice on the website.
8. No warranty
The Service is provided “as is” and “as available”. I work hard to make it reliable, but I cannot promise it will be error free or work on every Mac. Keep backups of work that matters to you. Rights you have under consumer law that cannot be excluded are not affected.
9. Limit of liability
To the extent the law allows, I am not liable for indirect or consequential loss, lost profits or lost data. My total liability for any claim about the app is limited to the amount you paid for it in the 12 months before the claim.
10. Changes
I may update these terms. The date at the top shows the latest version. Using the Service after a change means you accept it.
11. Governing law
These terms are governed by the laws of Bangladesh. Disputes will be handled by the competent courts of Bangladesh, unless mandatory consumer law where you live gives you the right to use your local courts.
